The auction will be conducted via raising bids (“bij opbod”) and decreasing bids (“bij afmijning”) in one session.


Offers in writing may be submitted for properties auctioned pursuant to Article 3:268, paragraph 2 of the Civil Code.


Submission of Offers
Offers must be submitted in writing to the creditor via the designated civil law notary no later than Wednesday, January 28th 2026, at 16:00 hrs (4:00 PM).
• Offers must be emailed or delivered to auction@sxmnotaryrichards.sx, accompanied by:
A valid passport or national ID (certified copy).
A creditor/bank guarantee letter supporting the bid.
Any offer not accepted within eight (8) days shall be deemed declined.


Auction Process & Seller’s Rights
The seller reserves the right to:
Adjust the Reserve Price before the auction.
Postpone or cancel the auction at any time.
The auction will take place through:
Raising bids (“bij opbod”).
Decreasing bids (“bij afmijning”).
The seller retains sole discretion to accept or reject any bid.


Auction Costs & Buyer Responsibilities
All auction costs are borne by the buyer, which may include:
Outstanding ground rent (“erfpachtcanon”).
Outstanding property charges related to superficies rights.
Buyers should consult SXM Notary Richards for an estimate of notarial costs.


Bidder Identification & Legal Entities
Each bidder must present a valid passport or national ID at the auction.
Legal entities must submit at the auction:
A recent original extract from the Chamber of Commerce’s Commercial Register (No older than 3 months).
A True Copy of the current Articles of Association.


Bidder Guarantee Requirements
The successful bidder must provide a bank guarantee:
Issued by a bank supervised by the Central Bank of Curaçao and Sint Maarten.
Acceptable to the seller.
• Covering the highest bid plus auction costs.
